1. Agreement to Terms

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the VisualMoney website and platform (the "Service") operated by VisualMoney Inc. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.

2. Description of Service

VisualMoney is a cloud-based personal finance management tool designed to track accounts, budgets, investments, and forecast cash flow based on the methodologies of classic desktop software workflows. We provide software as a service; we do not provide certified financial, legal, or tax advice. Any financial decisions you make based on data presented within VisualMoney are strictly your own responsibility.

3. Accounts and Security

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions and Billing

VisualMoney offers both free and paid ("Pro") subscription tiers. Pro accounts are billed in advance on a recurring monthly or annual basis ("Billing Cycle"). Unless you cancel your subscription before your billing cycle ends, it will automatically renew.

A valid payment method is required to process the payment for your Pro subscription. By submitting such payment information, you automatically authorize VisualMoney to charge all Subscription fees incurred through your account to any such payment instruments. All payments are non-refundable except where required by law.

5. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To attempt to probe, scan, or test the vulnerability of any VisualMoney system or network or breach any security or authentication measures.
• To interfere with, or attempt to interfere with, the access of any user, host, or network, including sending a virus, overloading, or spamming the Service.

6. Third-Party Connections (Plaid)

Our Service allows you to connect your external bank accounts using Plaid Inc. By utilizing this feature, you grant Plaid and VisualMoney the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy.

7. Intellectual Property

The Service and its original content (excluding User-provided financial data), features, and functionality are and will remain the exclusive property of VisualMoney Inc. and its licensors. Microsoft and MS Money are trademarks of the Microsoft group of companies. VisualMoney is not affiliated with, endorsed by, or sponsored by Microsoft.

8. Limitation of Liability

In no event shall VisualMoney Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use or alteration of your transmissions or content.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and request data deletion via your account settings.
